Terms & Conditions – Cascais Yachting

These Terms & Conditions (“Agreement”) govern your participation in courses, training, and related activities provided by Cascais Yachting (“we”, “our”, or “the School”). By enrolling in a course or using our services, you (“the Student”) agree to these conditions.
1. Enrollment & Booking
1.1 Eligibility
- Participants must be at least 16 years old to attend adult sailing courses. Parental or guardian consent is required for minors under 18.
- Students must be in good physical health and able to swim at least 50 meters unaided. Any medical conditions must be disclosed during booking.
1.2 Booking Process
- Bookings can be made online, by phone, or in person.
- A deposit (typically 50% of the course fee) is required to secure a place.
- Full payment must be received no later than 1day before the course start date unless otherwise agreed.
1.3 Confirmation
- Bookings are confirmed via email upon receipt of payment. Please retain your confirmation email and bring it on the first day of your course.
2. Cancellations & Refunds
2.1 Student Cancellations
- Cancellations must be made in writing (email is acceptable).
- Refunds are issued based on notice given before course start:
- More than 30 days: 90% refund
- 15–30 days: 50% refund
- Less than 14 days: No refund
2.2 School Cancellations
- We reserve the right to cancel or reschedule courses due to:
- Unsafe weather conditions
- Instructor illness or absence
- Low enrollment (minimum participant numbers not met)
- In such cases, students may choose a full refund or rebooking at no additional cost.
2.3 No-shows & Early Departures
- No refunds or credits will be given for non-attendance or early departure once a course has started.
3. Safety & Conduct
3.1 Code of Conduct
Students must:
- Follow all instructions given by instructors and staff
- Wear personal flotation devices (PFDs) at all times on the water
- Refrain from disruptive, dangerous, or disrespectful behavior
- Comply with all School and marina rules
Failure to comply may result in removal from the course with no refund.
3.2 Alcohol & Drugs
- The use of alcohol or illegal substances during any School activity is strictly prohibited.
- We reserve the right to refuse participation if a student is suspected of being under the influence.
3.3 Safety Equipment
- All essential safety equipment will be provided by the School.
- Students are responsible for using equipment correctly and reporting any damage or malfunctions.
4. Health & Medical Information
4.1 Medical Disclosure
- Students must complete a Medical Declaration during registration.
- Certain health conditions (e.g., epilepsy, heart conditions) may require a physician’s clearance.
4.2 Emergency Procedures
- In case of a medical emergency, we will seek appropriate treatment and notify the emergency contact provided.
5. Equipment & Liability
5.1 School Equipment
- Students are responsible for the proper use and care of School equipment.
- Any damage caused by negligence may result in repair or replacement costs.
5.2 Personal Belongings
- The School is not responsible for loss, theft, or damage to personal belongings brought to the premises.
5.3 Insurance
- The School carries appropriate public liability insurance.
- Students are advised to carry personal travel or accident insurance covering water sports.
6. Course Requirements & Certification
6.1 Attendance & Participation
- Full attendance is required to complete most courses.
- Active participation and skill demonstration are necessary for certification (e.g., RYA, ASA).
6.2 Assessment
- Instructors will assess students’ performance based on official criteria.
- Certification is not guaranteed and is subject to student competence.
7. Weather & Environmental Conditions
7.1 Weather Disruption
- Sailing is weather-dependent. The School will adjust the schedule or activities based on conditions to ensure safety.
- Alternative shore-based instruction or theory sessions may be substituted in cases of poor weather.
7.2 No Weather Refund Policy
- Refunds will not be granted for sessions impacted by adverse weather if alternative instruction is provided.
8. Photography & Media
8.1 Media Release
- The School may take photos or videos during activities for promotional use (website, social media, brochures).
- Students may opt out in writing before the course start date.
9. Data Protection
9.1 Student Data
- All personal information collected is handled in accordance with data protection laws (e.g., GDPR).
- Data will be used solely for registration, safety, communication, and certification purposes.
10. Legal & General Provisions
10.1 Jurisdiction
- This Agreement is governed by the laws of Portugal. Disputes will be settled in the courts of Cascais, Portugal.
10.2 Force Majeure
- We are not liable for failure to perform our obligations due to circumstances beyond our control, including natural disasters, strikes, or government restrictions.
10.3 Limitation of Liability
- The School’s liability is limited to the amount paid for the course.
- We are not liable for indirect, consequential, or incidental damages.
11. Group Bookings & Private Instruction
11.1 Group Discounts
- Group rates may be available for parties of 4 or more. Discounts must be confirmed in writing.
11.2 Private Instruction
- Customized schedules and pricing are available upon request for private tuition.
- Standard cancellation terms apply unless otherwise specified.
12. Acceptance of Terms
By enrolling in a course or participating in School activities, the Student confirms that they:
- Have read and understood these Terms & Conditions
- Are physically fit for sailing and related activities
- Consent to the use of their data as outlined
